Terms and conditions of the online shop

§ 1. DEFINITIONS:

  1. Online shop - online shop available at: https://biały-lotos.wroclaw.pl/, operated by the Seller,
  2. Regulations - these Rules and Regulations of the Online Store referred to in Article 8 of the Act of 18 July 2002 on Electronic Service Provision (Journal of Laws of 2020, item 344, as amended),
  3. Seller - Marcin Jaworski trading as White Lotus Marcin Jaworski with its principal place of business at: al. Armii Krajowej 8 lok. 2, 53-540 Wrocław, entered in the Central Register of Business Activity and Information, NIP: 7542744628, REGON: 365119818, e-mail: kontakt@bialy-lotos.pl, tel; 
  4. Buyer - Consumer or Entrepreneur using the services provided electronically by the Seller as part of the Online Shop (including in particular by creating an Account) or concluding a Sales Contract with the Seller, 
  5. Consumer - consumer within the meaning of Article 221 Civil Code, i.e. a natural person with full legal capacity or - in cases provided for by law - with limited capacity to perform legal acts, concluding a Sales Agreement with the Seller or using services provided by the Seller electronically to the extent not directly related to his/her business or professional activity,
  6. Entrepreneur - entrepreneur within the meaning of Article 431 of the Civil Code, i.e. a natural person, a legal person or an organisational unit without legal personality, to which the Act grants legal capacity, conducting in its own name a business or professional activity, concluding a Sales Agreement with the Seller or using services provided by the Seller electronically,
  7. Registration form - a form available in the Online Shop for creating an Account,
  8. Account - a set of resources in the Seller's IT system, marked with an individual name (login) and password assigned to the Buyer, in which the Buyer's data is stored, including in particular information on submitted Orders, the establishment of which requires filling in the Registration Form by the Buyer,
  9. Order Form - a form available in the Online Shop which enables the Buyer to place an Order and to execute it after creating an Account, as well as without creating an Account,
  10. Order - a declaration of intent by the Buyer, constituting an offer to conclude a Sales Agreement with the Seller,
  11. Sales Contract - sales agreement within the meaning of the Civil Code concluded between the Seller and the Buyer remotely via an online shop, in the Polish language, concerning the purchase of Products,
  12. Basket - a virtual tool enabling the Buyer to aggregate the selected Products prior to their purchase and to calculate their value, whereby when selecting the Products the Buyer may freely manage the content of the Basket by adding or removing Products from it,
  13. Product - a movable item available in the Online Shop which is the subject of a Sales Contract,
  14. Proof of Purchase - a fiscal receipt or a VAT invoice issued by the Seller and confirming the conclusion of the Sales Agreement,
  15. Promotion - a strictly time-limited price discount on selected Products that may be subject to a Sales Contract, or any other benefit provided to the Buyer in connection with the conclusion of a Sales Contract or the creation of an Account,
  16. Newsletter - a service provided electronically by the Seller upon prior consent of the Buyer, consisting of automatic receipt by the Buyer at the e-mail address provided by the Buyer of the most important information, including commercial information, related to the Online Shop, 
  17. Materials - photographs of the Products and other materials (including, in particular, texts, graphics, logos, source codes) which are works within the meaning of the provisions of the Act of 4 February 1994 on Copyright and Related Rights (i.e.: Journal of Laws of 2019, item 1231, as amended), placed in the Online Shop and owned by the Seller or used by the Seller with the consent of a person or a third party who holds intellectual property rights to the Materials,
  18. Privacy policy - a document available in the Online Shop, setting out the principles related to the processing of personal data by the Seller within the framework of the Online Shop, being the Seller's fulfilment of the information obligation referred to in the provisions on the protection of personal data,
  19. Annex 1 (Complaint form) - the specimen form attached to these Terms and Conditions which enables a complaint to be made, as referred to in § 8 of these Terms and Conditions,
  20. Annex 2 - specimen statement of withdrawal from the Sales Agreement appended to the Terms and Conditions as referred to in § 10 of the Terms and Conditions,
  21. Civil Code - Act of 23 April 1964. - Civil Code (i.e.: Journal of Laws of 2020, item 1740, as amended).

§ 2. GENERAL PROVISIONS.

  1. These Terms and Conditions apply to Sales Contracts and other services provided by the Seller through the Online Shop.
  2. The services provided electronically by the Seller in the Online Shop consist of the Seller enabling the Buyer to: 
  1. conclude Sales Agreements in accordance with the provisions hereof,
  2. creating and maintaining an Account in the Online Shop,
  3. to receive the Newsletter,
  4. use of other services available in the Online Shop.
  1. Announcements, advertisements, price lists and other information about the Products given in the Internet Shop shall be regarded as an invitation to conclude a Sales Agreement, having regard to Article 71 of the Civil Code.
  2. The online shop sells on the territory and outside the borders of the Republic of Poland.
  3. All Products available in the Online Shop are original, brand new (free of defects) and in compliance with applicable standards, requirements and laws.
  4. The Seller shall exercise the utmost care in the performance of Sales Contracts and Orders. 
  5. Promotions may be organised in the Online Shop under the terms and conditions specified and made public in the Online Shop by the Seller.
  6. The provisions of these Terms and Conditions are not intended to exclude or limit any rights of the Buyer who is a Consumer to which he is entitled under generally applicable laws, including in particular the provisions of the Civil Code and the Consumer Rights Act of 30 May 2014 (i.e. Journal of Laws of 2020, item 287, as amended). In the event of any inconsistency between the provisions of these Rules and Regulations and the provisions referred to in this section, these provisions shall prevail.
  7. Starting from 1 January 2021 - in the case of an Entrepreneur being a natural person conducting business activity entered into the Central Register and Information on Business Activity (CEIDG), who concludes a Sales Agreement directly related to his/her business activity, when at the same time it follows from the content of the Sales Agreement, that it does not have a professional character for such an Entrepreneur, arising in particular from the subject of his business activity made available in CEIDG (including in particular the PKD numbers) - the provisions of these Regulations concerning the Buyer being a Consumer shall also apply to such an Entrepreneur, excluding the provision of Art. 558 § 1 second sentence of the Civil Code. The provisions of Article 563 and Article 567 § 2 of the Civil Code shall also not apply to the Entrepreneur referred to in this section from 1 January 2021.
  8. For effective use of the Online Shop, a computer with a processor of min. 200MHz, 64MB RAM, a graphics card supporting resolutions of 1024x768 and 256 colours and a web browser (e.g. Internet Explorer (version >= 6.0), Mozilla Firefox, Opera, Google Chrome, Safari or other), a keyboard or other pointing device, enabling correct filling in of electronic forms, an Internet connection with a minimum bandwidth of download 512 kbit/s, upload 128 kbit/s, as well as an active e-mail account.

§ 3. RULES FOR THE USE OF THE ONLINE SHOP. 

  1. The Buyer is obliged to use the Online Shop in a manner consistent with applicable law, rules of social coexistence and good morals, with due regard to respect for personal rights and intellectual property rights of persons or third parties. 
  2. The use of the Online Shop is entirely voluntary.
  3. The Buyer may not take any action that could affect the proper functioning of the Online Shop, including, in particular, the Buyer may not:
  1. interfere with the content and graphic elements of the Online Shop, 
  2. upload unlawful content to the Online Shop,
  3. introduce harmful data, in particular in the form of malicious software, i.e. viruses, spyware, etc., into the Online Shop as an IT system.
  4. use the Online Shop for purposes other than its intended use, i.e., in particular, he/she may not send SPAM or similar messages or conduct any business, commercial, advertising or promotional activities for his/her own benefit within the Online Shop.
  1. When completing the Registration Form or Order Form, the Buyer is required to read and accept the Terms and Conditions and Privacy Policy. 
  2. When using the Online Shop, the Buyer is obliged to provide truthful and factually correct data and information necessary to set up an Account or conclude and perform a Sales Contract.
  3. It is forbidden to transfer personal data of third parties via the Online Shop without their consent. In the case of natural persons without full legal capacity, their consent should be given by their statutory representatives or legal guardians.
  4. Both the Buyer and any other person accessing the Online Shop shall refrain from copying, modifying, distributing, reprinting, transmitting or using in any other way (including in particular for marketing, commercial or profit-making purposes), the Materials placed in the Online Shop without the written consent of the Seller or any other person or third party who holds intellectual property rights to the Materials, except for the use of such Materials within the framework of permitted use referred to in the provisions of the Act of 4 February 1994. on Copyright and Related Rights (i.e.: Journal of Laws of 2019, item 1231, as amended).
  5. A breach of the provisions of the preceding paragraph could constitute an infringement of the law and thus give rise to civil or criminal proceedings against the persons or entities engaging in such practices.
  6. The Buyer shall be fully liable to the Seller and to any person or third party for damages in connection with: 
  1. infringement by the Buyer of legal provisions, including in particular the rights of third parties or third parties and the provisions of these Terms and Conditions,
  2. incorrect or unauthorised use of the Online Shop, as well as for any related technical problems, loss of data or other damage to the operation of the Online Shop, including, in particular, for carrying out the activities referred to in point 3 of this paragraph,
  3. The Buyer's liability referred to in the preceding paragraph shall include both the repair of the damage to the Seller and to the third person or entity, as well as the incurring of additional costs which resulted from the damage, including in particular court costs, costs of legal representation, costs of enforcement proceedings and other reasonable costs incurred by the Seller in connection with the damage caused to him and in connection with claims by third persons or entities.

§ 4. SETTING UP AN ACCOUNT.

  1. The creation of an Account by the Buyer requires the Buyer to complete the Registration Form and click on the dedicated button. The Buyer will then receive an activation link at the email address provided in the Registration Form, which must be clicked for registration to be successfully completed.
  2. During the registration process, the purchaser sets up his/her own password.
  3. Once an Account has been set up in the manner referred to in the two preceding paragraphs, the Buyer shall immediately gain access to the Account by means of an individual login and password. An Account in the Online Shop is established for an indefinite period of time and its possession does not entail any financial obligations for the Buyer towards the Seller.
  4. An account can be deleted at any time directly by the buyer via the functionality available in the Online Shop and after further steps indicated in the Online Shop or by the buyer sending a request to delete the account to the e-mail address of the seller: kontakt@bialy-lotos.pl.

§ 5. RULES FOR PLACING AND PROCESSING ORDERS.

  1. The Buyer may place an Order: 
  1. within their Account after completing the Order Form at any time (24 hours a day, 7 days a week) - the Buyer should complete the Registration Form (create an Account), add Products to the Basket, complete the Order Form and confirm the Order with the dedicated button,
  2. by filling in the Order Form available without creating an Account at any time (24 hours a day, 7 days a week) - the Buyer should add the Products to the Basket, fill in the Order Form and confirm the Order with the dedicated button,
  3. to the Seller's e-mail address: kontakt@bialy-lotos.pl at any time (24 hours a day, 7 days a week) - the Buyer should indicate which Products are to be included in the Order in the e-mail message constituting the declaration of will to place the Order,
  1. Confirmation of the placement and acceptance of the Order for execution shall be sent to the Buyer by the Seller in the form of an e-mail message after the Order has been placed as indicated in the preceding paragraph. 
  2. The Sales Contract between the Seller and the Buyer shall be deemed to have been concluded upon the Buyer's receipt of the email referred to in the preceding paragraph. 
  3. Orders placed on working days from Monday to Friday after 7:00 a.m., as well as on Saturdays, Sundays and other public holidays referred to in the Act of 18 January 1951 on public holidays (i.e.: Journal of Laws of 2020, item 1920, as amended), will be forwarded for fulfilment on the next working day.
  4. Orders forwarded for fulfilment may be cancelled by the Consumer Buyer until the Product is dispatched. 
  5. The lead time for the Order (completing the Order and preparing it for dispatch) is 2 working days, subject to points 7 and 8 of this paragraph. 
  6. The time for completion of the Order referred to in point 6 of this paragraph may be postponed in the event of the occurrence of force majeure, which shall be understood as unavoidable, extraordinary, unforeseeable and uncontrollable circumstances, the effects of which could not have been avoided despite the taking of all reasonable measures, by the period of its duration.
  7. In the event of unavailability of a Product, the Buyer shall be informed thereof and may then agree to a longer lead time than that indicated in point 6 of this paragraph or cancel the ordered Product or the Order in its entirety. 
  8. The Seller reserves the right to cancel the Order if the Purchaser - despite being summoned - has not supplemented within 3 days the defects required for effective execution of the Order, taking into consideration § 6 item 6 of the Regulations.
  9. The maximum amount of the Order is PLN 5,000.00. Orders above the indicated amount can be placed directly at stationary outlets. 
  10. In transactions with a customer who is an entrepreneur, before confirming the order, the seller reserves the right to verify the customer's entry in the relevant register, including, but not limited to, white-listed account number, business address, NIP or other data to confirm the business activity. 

§ 6. PAYMENTS.

  1. In connection with the fulfilment of Orders and Contracts, the Seller shall be entitled to remuneration at the prices available on the Online Shop and in force at the time the Order is placed.
  2. The prices given in the Online Shop are expressed in Polish zloty, are gross prices and include all components, including VAT and customs duties. However, the prices do not include possible costs of Product delivery, which are indicated before the Order is placed.
  3. The Buyer is informed of the total price for the Products included in the Order, which includes delivery costs, before the Order is placed.
  4. Each Order is accompanied by a Proof of Purchase, whereby the Buyer agrees that as a Proof of Purchase they will receive an electronic invoice to the email address provided on the Registration Form or Order Form, if the Buyer so wishes and selects the relevant option when placing the Order.
  5. The Buyer may, when placing an Order, make payment via tPay online platforms - the Order shall not be dispatched until the full amount for the Order has been successfully authorised,
  6. If the Buyer fails to make payment within 3 days from the date of confirmation of the Order, the Seller may summon the Buyer to make payment within a period of not less than 3 days. The summons shall be sent in documentary form in the form of an e-mail message. If the summons is not complied with within the indicated time limit, the Seller may cancel the Order by informing the Buyer by e-mail or telephone.
  7. In the event of a delay in payment by the Buyer who is an Entrepreneur, the Seller shall be entitled to statutory interest for delay in commercial transactions and recovery costs in accordance with the provisions of the Act of 8 March 2013 on the prevention of excessive delays in commercial transactions (i.e.: Journal of Laws of 2020, item 935, as amended).
  8. Online payments made online through the Online Store, as referred to in point 5 of this paragraph, are handled through the tPay platform available at www.transferuj.pl - by Krajowy Integrator Płatności S.A. with its registered office at: ul. Św. Marcin 73/6, 61-808 Poznań, KRS: 0000412357, NIP: 7773061579, REGON: 300878437, registered as a National Payment Institution in the Register of Payment Services kept by the Polish Financial Supervision Authority at the UKNF under number: IP27/2014.

§ 7 SUPPLY.

  1. When placing an Order, the Buyer may - at his discretion - choose one of the following ways of collecting the ordered Products:
  1. delivery of the Products to the Buyer's address given when the Order was placed by a courier company, 
  2. receipt of ordered Products by e-mail to the e-mail address provided during registration.
  1. Delivery costs are charged in accordance with the current delivery price lists and depend on the weight and size of the parcel. The Buyer is informed of the delivery costs before placing the Order. In the case of shipping the Product outside of the country, the cost of delivery is determined individually based on the estimated weight of the parcel and the country of destination.
  2. The costs of delivery shall be borne by the Buyer, however the Seller undertakes to cover the costs of delivery within Poland if the value of the Order exceeds PLN 500.00.
  3. The Buyer undertakes to take back the Product sent.
  4. A Buyer who is an Entrepreneur is obliged to check the consignment in the presence of a courier or Poczta Polska employee at the time of delivery, excluding the Entrepreneur referred to in § 2 item 9 of the Terms and Conditions.
  5. For the Buyer who is a Consumer and the Entrepreneur referred to in § 2 point 9 of the Terms and Conditions, the Seller recommends checking the parcel in the presence of the courier or Poczta Polska employee. Failure to check the consignment does not stop the possible complaint referred to in § 8 of the Terms and Conditions, however, if such verification is made, the complaint procedure will be significantly improved. 
  6. Before sending the goods, the Seller verifies the address provided by the Buyer with the addresses listed in the database of the Polish Post or courier companies. If an incorrect address is found, the Seller contacts the Buyer by e-mail, informing him of the found irregularities or doubts, in order to confirm the delivery address. If the Seller does not receive a response regarding the address from the Buyer within 3 days from the date of the Seller's email, then the order will be cancelled. Information about the cancellation of the order due to any irregularities found in the delivery address will be sent to the Buyer in the form of an email by the Seller. 
  7. In the case of orders carried out by a Buyer who is not a consumer, the Seller reserves the right to verify the address indicated by the trader, if it is not the same as the address of the main plant, business activity or registered office of the trader - by contacting him by phone or e-mail, in order to confirm the correctness of the address. If the delivery address is not confirmed within 3 days of the order, the Seller is entitled to cancel the order. Information about cancellation of the order due to ascertained irregularities in the delivery address will be sent to the Buyer in the form of an e-mail by the Seller.

§ 8. COMPLAINT.

  1. The Seller shall be liable under the warranty for defects in the Product if the defect is discovered before the expiry of two years from the date of delivery of the Product to the Buyer.
  2. Slight differences in the appearance of the Products resulting from the individual settings of the Buyer's computer, including in particular the monitor, may not be considered by the Seller as sufficient grounds for a Product complaint.
  3. If the Buyer discovers that the delivered Product has a defect, the Buyer is obliged to inform the Seller.
  4. The complaint should contain: the Buyer's data, information concerning the Product and the Order, description and date of the Product's defect and the Buyer's request. The Buyer is also obliged to provide the original or a copy of the Proof of Purchase or other proof of purchase of the Product under complaint, as well as to send back the Product under complaint so that the complaint can be processed.
  5. In order to facilitate the complaint procedure, the Seller makes the Complaint Form available on the website of the Internet Shop, which constitutes Attachment No. 1 to these Regulations.
  6. Complaints should be submitted:
  1. in case of paper form - by mail to the Seller's address: al. Armii Krajowej 8 lok. 2, 53-540 Wrocław,
  2. in the case of e-mail, to the Seller's e-mail address: kontakt@bialy-lotos.pl.
  1. If the data or information provided in the complaint needs to be supplemented, the Seller will ask the complainant to supplement the complaint in the indicated scope before considering the complaint. 
  2. The Seller undertakes to consider a complaint made by a Buyer who is a Consumer, who, within the framework of the complaint, demanded replacement of the Product or removal of the defect or made a declaration of price reduction, specifying the amount by which the price is to be reduced, within 14 days from the date of its submission or supplementation by the Buyer. If the Seller, in the case referred to in this clause, does not respond to the complaint within the indicated period, it shall be assumed that the Seller acknowledged the complaint as justified. 
  3. The Seller's liability under warranty towards Purchasers who are Entrepreneurs is completely excluded, which does not apply to Entrepreneurs referred to in § 2 item 9 of the Terms and Conditions.

§ 9. WITHDRAWAL FROM THE SALES CONTRACT.

  1. The Buyer who is a Consumer shall have the right to withdraw from the Sales Contract as a distance contract, without giving any reason, within 14 days from the date of receipt of the Product, unless the exclusion referred to in point 9 of this paragraph applies.
  2. The exercise of the right referred to in the preceding paragraph shall require the Buyer to submit a declaration of withdrawal from the Sales Agreement within the indicated period:
  1. in case of paper form - by mail to the Seller's address: al. Armii Krajowej 8 lok. 2, 53-540 Wrocław,
  2. in the case of e-mail, to the Seller's e-mail address: kontakt@bialy-lotos.pl.
  1. In order to facilitate the submission of the statement of withdrawal from the Sales Agreement, the Seller makes available on the website of the Internet Shop a model statement constituting Attachment No. 2 to these Terms and Conditions. 
  2. When withdrawing from the Sales Agreement, the Buyer is obliged to return the Product together with the original or a copy of the Proof of Purchase or other proof of purchase of the returned Product, within 14 days from the date of submitting the Sales Agreement withdrawal statement. Returns of Products covered by the statement of withdrawal from the Sales Agreement, sent at the Seller's expense or COD, will not be accepted by the Seller. 
  3. The shipping costs for the returned Product shall be borne by the Buyer.
  4. The Buyer shall be liable for any diminution in the value of the Product resulting from use beyond that which is necessary to ascertain the nature, characteristics and functioning of the Product.
  5. The Seller shall return to the Buyer the price of the Product and the costs of the cheapest standard delivery method incurred by the Buyer when purchasing the Product not later than within 14 days from the date of delivery of the Product covered by the withdrawal from the Sales Agreement, taking into account point 8 of this paragraph. 
  6. The Seller shall refund the payment using the same method of payment that the Buyer used to purchase the Product, unless the Buyer has expressly agreed to a different method of refund that does not involve additional costs for the Buyer. However, if the Buyer has chosen other than the cheapest ordinary method of delivery of the Product offered by the Seller, the Seller shall not be obliged to reimburse the Buyer for the additional costs incurred by the Buyer. 
  7. The right of withdrawal from the Sales Contract referred to in this paragraph shall not apply in the event of: 
  1. provision of services, if the Seller has performed the service in full with the express consent of the Buyer, who has been informed before the performance of the service by the Seller that after the Seller's performance he will lose the right to withdraw from the Sales Agreement,
  2. agreements relating to services for which the price or remuneration depends on fluctuations in the financial market over which the Seller has no control, and which may occur before the expiry of the deadline for withdrawal from the Sales Agreement,
  3. Sales contracts where the object of performance is a non-refabricated item manufactured to the Buyer's specifications or intended to meet the Buyer's individual needs,
  4. Sales Contracts where the object of performance is a perishable item or an item with a short shelf life,
  5. Sales contracts whose object of performance is an item supplied in sealed packaging which cannot be returned after opening for health or hygiene reasons, if the packaging has been opened by the Buyer after delivery,
  6. specific Sales Contracts where the subject matter of the performance is items which, by their nature, are inseparable from other items after delivery,
  7. Sales Contracts the subject of which are alcoholic beverages for which the price has been agreed upon at the conclusion of the Sales Contract and delivery can only take place after the expiry of 30 days and their value depends on fluctuations in the market over which the Seller has no control,
  8. contracts in which the Buyer has expressly requested that the Seller come to him to carry out urgent repairs or maintenance, whereby if the Seller provides services in addition to those requested by the Buyer or supplies items other than spare parts necessary for carrying out the repair or maintenance, the Buyer shall have the right to withdraw from the contract in respect of the additional services or items,
  9. Sales contracts for the provision of sound or visual recordings or computer software supplied in sealed packaging if the packaging has been opened by the Buyer after delivery,
  10. the supply of newspapers, periodicals or magazines, with the exception of a subscription contract,
  11. Sales contracts concluded by public auction, 
  12. contracts for the provision of accommodation other than for residential purpose, carriage of goods, car rental, catering, services related to leisure, entertainment, sports or cultural events, if the contract concluded specifies the date or period of the service provision,
  13. contracts for the supply of digital content not recorded on a tangible medium if the performance has begun with the express consent of the Buyer before the end of the period for withdrawal and after the Seller has informed the Buyer of the loss of the right of withdrawal.
  1. Details regarding the exercise of the right to withdraw from the Sale Contract - as a distance contract - are set out in the provisions of the Consumer Rights Act of 30 May 2014 (i.e.: Journal of Laws of 2020, item 287, as amended).
  2. The provisions of this paragraph shall not apply to Purchasers who are Entrepreneurs other than those referred to in § 2 item 9 of the Terms and Conditions, for whom the right to withdraw from the Sales Agreement on the principles provided for in this paragraph is strictly excluded.

§ 11. PROTECTION OF PERSONAL DATA.

  1. The seller is the administrator of the buyers' personal data.
  2. The Seller, as Administrator, processes personal data in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation), the Act of 10 May 2018 on the protection of personal data (i.e.: Journal of Laws of 2019, item 1781, as amended) and other relevant data protection regulations.
  3. The Buyer may consent to the Seller processing his/her personal data in order to receive the Newsletter at the e-mail address indicated by the Buyer.
  4. All detailed rules concerning the processing of personal data, including in particular the purposes and legal basis of the processing and the rights of Buyers as data subjects, are contained in the Privacy Policy.

§ 12. FINAL PROVISIONS.

  1. The Seller reserves the right to introduce restrictions on the use of the Online Shop due to its technical service, maintenance work or work on improving its functionality. At the same time, the Seller undertakes to make every effort to ensure that such restrictions and interruptions take place during night hours and last as short as possible. 
  2. The Seller reserves the right to amend these Terms and Conditions. Amendments shall come into force at the time expressly indicated by the Seller, not earlier than 7 days after their announcement. Orders placed prior to the entry into force of the amendments referred to in the preceding sentence shall be realised on the terms in force at the time of their placement. The Purchaser who does not agree with the changes introduced in these Terms and Conditions should refrain from further use of the Online Store.
  3. Any disputes between the Seller and the Buyer - subject to their mutual agreement - shall be resolved amicably or in the presence of an independent and impartial mediator. 
  4. A buyer who is a Consumer may:
  1. make use of the out-of-court ways of handling complaints and pursuing claims referred to in the Act of 23 September 2016 on out-of-court resolution of consumer disputes (Journal of Laws of 2016, item 1823, as amended), and the entity authorised to conduct proceedings on out-of-court resolution of consumer disputes to which the Seller is subject is the Lower Silesian Regional Inspector of Commercial Inspection in Wrocław (address: ul. Ofiar Oświęcimskich 15a, e-mail: sekretariat@wiih.wroclaw.pl, website: www.wiih.ibip.wroc.pl),
  2. file a complaint via the EU ODR online platform, available at the link: http://ec.europa.eu/consumers/odr/.
  1. If it is not possible to resolve a dispute amicably, the court with jurisdiction over the dispute will be the court with jurisdiction over the registered office/head office of the Seller (i.e. the court in Wrocław), and in the case of a Buyer who is a Consumer, the court with jurisdiction according to the general rules.
  2. Any matters not covered by these Terms and Conditions shall be governed by the relevant provisions of generally applicable law, including in particular the provisions of the Civil Code, the Consumer Rights Act, the Copyright and Related Rights Act and the provisions on personal data protection.
  3. The regulations are effective as of 23.04.2024.
